WEBINAR RECORDING OFFERS ANALYSIS OF MARKS v. CRUNCH ON ARM INDUSTRY
- Thursday’s Telephone Consumer Protection Act ruling in Marks v. Crunch San Diego is still reverberating through the collections industry as agency executives rush to figure out what is and what is not allowed, as it relates to using an automated telephone dialing system to contact individuals with unpaid debts. David Kaminski, a partner at the law firm of Carlson & Messer, walked through the ruling and discussed the impact on contacting individuals for collection agencies during a webinar last Friday. The webinar, which was sponsored by TCN, offered some initial insights and answered many questions from agency executives about the ruling and what it means going forward.
WASHINGTON AG FILES LAWSUIT AGAINST COMPANIES FOR COLLECTING WITHOUT A LICENSE
- The attorney general of Washington has filed a lawsuit against three collection agencies and the individual who owns them, alleging the entities purchased debts owed by people living in Washington and subsequently sued to collect on those debts without having the proper license to operate in the state.
SETTLEMENT BARS MORE DEFENDANTS FROM ARM INDUSTRY
- The remaining defendants in a lawsuit filed by the Federal Trade Commission and the attorney general of New York have reached a settlement where they will be permanently barred from participating in the collections industry. Friday’s announcement likely brings to a close a case that began back on 2015 when the AG of New York and the FTC brought charges against the defendants, alleging they falsely threatened imprisonment for individuals who did not make payments on their debts.
UTAH SCHOOL DISTRICT ISSUES RFP FOR COLLECTIONS CONTRACT
- A school district in Utah has put out a Request For Proposal seeking a collection agency to help it recover $100,000 in unpaid fees. The schools in the district have been trying to collect the fees on their own, but are running into problems because there are “no consequences” for unpaid fees, according to a published report.
