NINTH CIRCUIT ISSUES RULING IN MARKS v. CRUNCH, OVERTURNS LOWER COURT
- It was the shot heard ’round the ARM industry yesterday. Mid-afternoon, word started getting around that the Ninth Circuit had issued its long-awaited ruling in Marks v. Crunch. The case, which centered around the definition of what constitutes an automated telephone dialing system, did not break the industry’s way. Ruling that an ATDS is any device that stores numbers, regardless of whether those numbers are generated randomly or by a sequential number generator, the Ninth Circuit’s ruling sets the stage for a possible Supreme Court battle on the topic. JURY AWARDS $161K TO PLAINTIFF AFTER LAWYER TRIES TO COLLECT ON SETTLED DEBT
- A jury in the state of Washington has awarded a plaintiff $161,000 after he sued a collection agency and a law firm for violating the Fair Debt Collection Practices Act, the Washington Collection Agency Act, and the Washington Consumer Protection Act for allegedly attempting to collect on a debt that had already been settled.
NEW LAW TO PREVENT COLLECTORS FROM REPORTING SCHOOL DEBTS TO CREDIT BUREAUS
- California Gov. Jerry Brown has signed a bill into law that will prevent schools from withholding diplomas from students who have unpaid school debts and will prohibit schools and school boards from penalizing the parents of students for failing to pay their school debts. The bill — the Primary Education Fair Debt Collection Act — passed both houses of the California legislature earlier this year.
