FTC, NY AG ACCUSE DEBT BROKER, AGENCY OF SELLING, COLLECTING ON FAKE DEBTS
- The FTC and the AG of New York have charged a group of companies and individuals with violating the FDCPA as well as New York state law in collecting on counterfeit debts that individuals did not owe. To make matters worse for the defendants, they allegedly used illegal tactics to attempt to collect on the debts, including failing to provide required notices about the debt and consumers’ rights to dispute the debt, and threatening to contact, or contacting, family members or other third parties.
APPEALS COURT RULES DEFENDANT CAN’T COMPEL ARBITRATION IN TCPA CASE
- The Eleventh Circuit Court of Appeals has upheld a lower court’s decision denying a defendant’s motion to compel arbitration in a Telephone Consumer Protection Act case because text messages sent by the defendant fall outside the scope of an original agreement between the two parties.
