APPEALS COURT AFFIRMS SUMMARY JUDGMENT IN FAVOR OF DEFENDANT IN TCPA ATDS CASE
- The Third Circuit Court of Appeals has upheld a summary judgment ruling in favor of Yahoo after it was sued by a plaintiff for allegedly violating the Telephone Consumer Protection Act by sending him more than 27,000 automated text messages he did not provide consent to receive.
REPORT CALLS ON CALIF. COUNTIES TO CANCEL CONTRACTS WITH COLLECTION AGENCIES
- A consumer advocacy in California has published a report calling for an overhaul of the process that allows government-created debt, such as traffic violations and probation costs, to be placed with private collection agencies. The report goes as far as to recommend that all contracts with private collection agencies should be terminated or debts should be discharged before the accounts are placed with collection agencies.
SOUTH CAROLINA ENACTS TELEPHONE PRIVACY PROTECTION LAW
- The South Carolina legislature has approved a bill that became law last month which places restrictions on companies attempting to contact individuals in the state via phone calls or text messages. The South Carolina Telephone Privacy Protection Act mostly applies to telephone solicitations but does include some language and definitions that could be applied more broadly.
