COURT RELIES ON CONGRESSIONAL INTENT TO GRANT SUMMARY JUDGMENT IN TCPA CASE
- A ruling in an interesting case from the District Court for the Western District of New York in which Navient Solutions was granted summary judgment after being sued for allegedly violating the Telephone Consumer Protection Act. What makes the case interesting is that the case hinges on Congress instructing the FCC to implement rules regarding the permission for entities collecting on behalf of the federal government to use automated telephone dialing systems, but the FCC never following through and actually implementing the rule.
BILLS INTRODUCED IN HOUSE, SENATE TO EXPAND AUTODIALER DEFINITION
- Companion bills have been introduced in the House of Representatives and the Senate aimed at expanding the definition of automated telephone dialing systems to include platforms that make calls from numbers stored on a list, as well as those that use random or sequential number generators.
THINK-TANK PUBLISHES RECOMMENDATIONS FOR IMPROVING CFPB RULEMAKING PROCESS
- As the Bureau of Consumer Financial Protection (slowly) considers a rule governing debt collections, a right-leaning think-tank has published its recommendations for how the agency should approach its rulemaking process. The Competitive Enterprise Institute has a series of recommendations for the CFPB because rules that have been issued “have not been based on robust research or consumer desire for regulation,” and instead “have been driven by the Bureau’s ideological hostility to the financial services industry.”
IRS PRIVATE COLLECTION PROGRAM TARGETING LOW-INCOME TAXPAYERS
- Nina Olson, the National Taxpayer Advocate, whose job it is to protect the rights of taxpayers, has come out again opposing the use of private collection agencies (PCAs) to collect on unpaid tax debts. Olson, in a blog post published last week, also said she has directed the Internal Revenue Service to stop placing certain accounts with the four agencies hired to work on behalf of the tax agency.
U.K. DOOR-TO-DOOR DEBT COLLECTOR MURDERED
- A tragic story out of the U.K. where a door-to-door debt collector was murdered over the weekend. Tina Cantello, a 49-year-old debt collector, was making the third of three house calls on Friday night when she did not return home. Her body was found a day later, after an exhaustive search had been launched.
