ACA INTERNATIONAL PART OF GROUP THAT PETITIONS FCC FOR NEW AUTODIALER DEFINITION
- ACA International, along with 17 other trade groups, yesterday submitted a petition to the Federal Communications Commission, seeking a declaratory ruling on what an automatic telephone dialing system (ATDS) actually is. The petition is a follow up to a ruling in a lawsuit filed by ACA International against the FCC that was issued in March by the Court of Appeals for the District of Columbia.
EDUCATION DEPT. ANNOUNCES TERMINATION OF CONTRACT WITH PRIVATE COLLECTION AGENCIES
- The Department of Education (ED) yesterday filed a notice that it plans to cancel the contract it awarded to Performant Financial Corp. and Windham Professionals to collect on unpaid student loans. While the news was not altogether a surprise, it does add a new chapter into a process that has been ongoing for more nearly a decade as the department seeks help in collecting on unpaid student loans that are guaranteed by the federal government.
PHH DOES NOT FILE APPEAL WITH SUPREME COURT, ENDING LANDMARK CASE AGAINST CFPB
- The case that thrust the director of the Bureau of Consumer Financial Protection into the spotlight as one of the most powerful individuals in the federal government appears to be over. PHH Mortgage did not appeal a ruling from the Court of Appeals for the District of Columbia to the Supreme Court, meaning the Appeals Court’s January decision that the leadership structure of the agency is constitutional will stand.
VIRGINIA SUES ONLINE LENDER FOR VIOLATING STATE CONSUMER PROTECTION LAW
- The state of Virginia has filed a lawsuit against Net Credit, alleging the online lender made more than 47,000 loans totaling more than $47 million, which are illegal and violate the state’s usury law. The lender violated the state’s 12% interest rate cap and made loans with rates as high as 149%, according to the complaint.
