APPEALS COURT RULING REINSTATES TCPA CASE, DEEMS EVERY TCPA VIOLATION TO BE CONCRETE
- The Ninth Circuit Court of Appeals has reinstated a Telephone Consumer Protection Act case after more than 300 collections calls that were made to an individual after she had revoked consent to be contacted. The Ninth Circuit ruling overturned a ruling at the District Court level in California that had dismissed the plaintiff’s complaint because it ruled the plaintiff lacked standing under Article III to file suit.
DEBT COLLECTION COMPLAINTS STILL TOP LIST IN FTC REPORT, BUT NUMBER HAS DROPPED BY 30% IN TWO YEARS
- The Federal Trade Commission yesterday released data on the number of “complaints” it received in 2017, and while the total number was lower than what it received in 2016, debt collection was still the most popular topic. Debt collection reports made up more than 22% of the total, in 2017. There were 608,535, which is more than 50% higher than the next-most-complained about category, identity theft.
CFPB WANTS MORE ‘LEADERSHIP’ FROM STATE AGs
- Speaking to a group of state attorneys general earlier this week, Mick Mulvaney, the acting director of the Consumer Financial Protection Bureau, again laid out his more relaxed enforcement plan for the agency, and added that he will be relying on AGs to pick up the slack when it comes to regulating financial services organizations, including debt collectors.
CFPB ANNOUNCES REVIEW OF CONSUMER COMPLAINT PROCESS
- The Consumer Financial Protection Bureau has announced the latest area of its operation that it is opening up for review – the consumer complaint process. This marks the sixth such review that the CFPB has rolled out in the past two months. The others include: the civil investigative demand letter process, the administrative adjudication process, the external engagement process, the supervision process, and the enforcement process.
PRA GROUP OPENS NEW N.C. CALL CENTER
- PRA Group has officially opened its newest call center, in the Holly Hill Mall and Business Center in Burlington, N.C. The company has hired about half of the 500 workers it plans on employing at the center, a representative from PRA Group said in a published report.
CAR AFFORDABILITY MAY BE AT BREAKING POINT
- The ability for individuals to be able to afford a cay payment may be at its breaking point, according to data released yesterday by Experian. The average new car price was $31,099, and the average car loan payment was $515. “I think we’re certainly at a point where affordability is a question,” said Melinda Zabritski, Experian’s senior director of automotive finance solutions.
