NAVIENT BEATS MOTION TO DISMISS IN TCPA RACKETEERING LAWSUIT AGAINST LAW FIRM, DEBT RELIEF COMPANIES
- Student loan servicer Navient Solutions has successfully defended against motion to dismiss in a racketeering lawsuit it filed last October against Krohn & Moss, a consumer law firm based in Chicago. Navient filed the lawsuit against the firm and a number of other defendants because they allegedly were offering tutorials on how to manufacture lawsuits alleging violations of the Telephone Consumer Protection Act as a means of getting rid of their student loans.
‘CLUMSY’ NOTIFICATION PROCESS BY DoE MAY HAVE HELPED INVESTORS CASH IN
- The Department of Education may have inadvertently given some individuals a headstart on buying stock of in one of the companies awarded a federal contract to collect on student loans. When notifying 40 companies were notified via email on Jan. 11 that they were not selected, the email also mentioned the names of the two winning firms. In the 150 minutes following that email and the filing of a court document that publicly announced the two winning firms, trading activity in shares of one of the companies, which is public, spiked.
HEARING WITNESS HAS HARSH WORDS FOR BILL THAT WOULD UNDO MADDEN RULING
- A witness at a subcommittee hearing of the House Financial Services Committee to be held today has harsh words for a bill that would undo a court ruling which holds that a subsequent purchaser of a loan is protected by the same laws that were used to originate that loan in the first place. If passed, the bill would facilitate “unrestricted” payday lending, Levitin said in his prepared testimony.
