REPORT BREAKS DOWN CONSUMER COLLECTIONS DATA BY STATE, COUNTY
- The 46% of Louisianans who have a debt in collection represent the highest percentage of any state in the country, according to a report issued by The Urban Institute. Following Louisiana are Texas (44%) and South Carolina (43%). By contrast, Minnesota (17%), South Dakota (18%), and North Dakota (19%) are the states with the lowest percentage of individuals with a debt in collections.
DEFENSE DEPT. TO UPDATE COLLECTION REGS TO MATCH CIVILIAN PROTECTIONS
- The Department of Defense must now update its regulations regarding debt collections of military personnel to align them with civilian regulations, according to a bill that was signed into law by President Trump yesterday. The regulation is part of the National Defense Authorization Act.
REPORT CALLS ON DEPT. OF EDUCATION TO PROCESS DEBT FORGIVENESS CLAIMS
- The chief investigator for the Department of Education has issued a report, urging the department’s Office of Federal Student Aid (FSA) to move forward on tens of thousands of debt forgiveness applications that have been sitting around for more than a year. Between the period of July 1, 2016 and January 20, 2017, under the Obama administration, the FSA approved 27,986 out of 46,274 debt forgiveness applications. Since January 20, 2017 — when Betsy DeVos became the Secretary of Education — the FSA has approved none of the 25,991 applications that have been submitted.
APPEALS COURT RULES ALL MEMBERS OF UNCERTIFIED CLASSES MUST BE NOTIFIED OF SETTLEMENT OR DISMISSAL
- The New York City Court of Appeals has ruled that all members of a putative, uncertified class-action must be notified when the lawsuit has been settled or dismissed. Previously, the rule had only been applied to certified class actions, with respect to a state law in New York.
TEXAS COUNTY SHERIFF CLOSES COLLECTIONS UNIT
- The Wichita County (Texas) Sheriff’s office has decided to close its collections department, which went after individuals with unpaid fines and court costs, because of budget cuts.
AUTO LOAN DELINQUENCY RATES EXPECTED TO KEEP RISING IN 2018
- Auto loan delinquency rates will continue to rise in 2018, but will remain below the historical highs experienced during the Great Recession a decade ago, according to data released yesterday by TransUnion. Auto loans that are at least 60 days behind on payments are projected to be 1.46% at the end of 2018, up from 1.43% at the end of this year.
