MASS. AG ANNOUNCES $1 MILLION CONSENT ORDER AGAINST COLLECTION LAW FIRM
- The Attorney General of Massachusetts has announced a $1 million consent order against the collection law firm of Lustig, Glaser & Wilson, P.C., the largest collection law firm in the state. As part of the order, the law firm admitted no wrongdoing and one of the partners at the firm strongly defended the company’s actions. Under the terms of the settlement, the firm will now verify that consumers are in fact in debt before trying to collect from them, and will stop using civil arrest warrants and court hearings to pressure consumers who are unable to repay their debts.
TWO MEMBERS OF NORTH CAROLINA SCAM RING HAVE BAD DAYS IN COURT
- A couple of updates in the case of RJ Financial, a debt collection agency that was used to scam individuals into making payments on non-existent debts. One of the defendants, Miranda Bailey, who pleased guilty to wire fraud and mail fraud conspiracy, was approached by a TV news reporter following her court hearing yesterday and instead of “no comment,” she opted to use obscene gestures instead. Another member of the scam, John Perry, Jr., was denied bail on his charges because he was involved in the alleged scheme while he was out on bond awaiting trial in another white-collar crime case. In that case, Perry ended up being sentenced to two years in prison.
THIRD CIRCUIT HOLDS ONE CALL ENOUGH TO JUSTIFY CONCRETE HARM
- Another blow to companies that are trying to use the Spokeo defense. In this case, a woman received a single, unsolicited call on her cell phone from a fitness gym and claimed that the time it took to retrieve the voicemail message, the depletion of her cell phone battery, and reduced her available cell phone minutes was enough to justify concrete harm. The Third Circuit Court of Appeals agreed.
