PROFESSIONAL PLAINTIFFS FILE PETITION WITH FCC TO REVISE TCPA

  • A pair of professional plaintiffs have filed a petition with the Federal Communications Commission to revise the Telephone Consumer Protection Act so that the “prior express consent” standard that applies to businesses making calls via an autodialer mirrors the “prior expressed written consent” that is now the rule for making marketing calls. If enacted, the revision create a situation where a business would never be able to contact a consumer via ATDS text or recorded voice call without having the very specific consent, in writing, by the consumer.

UTAH CONGRESSWOMAN INTRODUCES BILL TO AMEND FDCPA

  • Rep. Mia Love [R-Utah], the first black Republican female member of Congress, has introduced another bill aimed at amending the Fair Debt Collection Practices Act. The bill, H.R. 864, titled “Stop Debt Collection Abuse Act of 2017,” is exactly the same piece of proposed legislation that she introduced last summer.

  • The Consumer Financial Protection Bureau’s Financial Education Exchange has announced it is holding a webinar today on “consumer views and experiences in debt collection.” The webinar appears to be tied to a report that is being touted as “the first of its kind,” providing “in-depth analysis of consumer’ encounters with the debt collection industry.” The webinar is being held today from 2pm to 3pm ET.
