APPEALS COURT GRANTS FULL RE-HEARING IN PHH v. CFPB 

  • The Court of Appeals for the District of Columbia has granted the request of the Consumer Financial Protection Bureau to have the entire bench re-hear the case, PHH Corp. v. CFPB. A three-judge panel from the Court ruled in October that the leadership structure of the CFPB to be unconstitutional, which set off a firestorm, calling for the firing of agency director Richard Cordray. Oral arguments for the re-hearing will be in May. A final ruling is expected by the end of the summer. A copy of the ruling can be read here.

NEW YORK ANNOUNCES ENACTMENT DATE FOR CYBERSECURITY REGULATIONS

  • The state of New York has announced that its proposed cybersecurity regulations governing financial services organizations will go into effect on March 1. The regulation covers any organization regulated by the state’s Department of Financial Services and requires those companies to establish and maintain a cybersecurity program designed to protect consumers’ private data.
