NEB. COLLECTION AGENCY TO PAY $500K AS PART OF FDCPA SETTLEMENT

  • Credit Management Services, a Nebraska collection agency, will pay $198,000 to 11,552 members of a class-action lawsuit, as well as pay $315,000 in attorneys fees after the terms of a settlement were finalized this week. The collection agency was accused of trying to collect pre-judgment interest and attorney’s fees prior to the conclusion of the 90-day window mandated by the Fair Debt Collection Practices Act.

DISTRICT COURT IN 11th CIRCUIT DISMISSES CLAIM THAT ACCOUNT NUMBER ON ENVELOPE VIOLATES FDCPA 

  • A district circuit has joined two Circuit Courts and numerous other districts in accepting the “benign language” exception to the Fair Debt Collection Practices Act (FDCPA), in a case dismissing a claim that an envelope with a barcode that contains the debtor’s account number violated the statute. This District Court, the U.S. Court for the Southern District of Florida, is in the 11th Circuit, and follows similar rulings in the Fifth and Eighth Circuits as well. The case was Efran Martell v. ARS National Services.
