DISTRICT COURT: COLLECTORS CAN ATTEMPT TO COLLECT FEES WITH PRINCIPAL BALANCE
- The District Court for the Eastern District of New York has ruled that debt collectors are not violating the Fair Debt Collection Practices Act when they attempt to obtain payment of collection fees at the same time as the unpaid balance and can request “prompt” contact in a validation notice, provided the 30-day dispute language is also included in the notice.
CFPB ISSUES REGULATORY UPDATE OVER SERVICE PROVIDER RISK MANAGEMENT
- The Consumer Financial Protection Bureau has issued a regulatory update, clarifying that companies regulated by the agency have some flexibility when it comes to oversight of their service providers. The new language indicates that the CFPB expects the risk management oversight performed by companies on their service providers be reflective of the “size, scope, complexity, importance and potential for consumer harm” being performed by the service provider.
