PETITIONERS FIGHTING AGAINST FCC’S CHANGES TO TCPA ASK FOR MORE TIME TO MAKE ORAL ARGUMENTS
- ACA International and its fellow petitioners have filed a motion asking for more time for their oral arguments in their case against the Federal Communications Commission, because of “complex” issues that are “important to a wide swath of the American economy.” Normally, oral arguments are 15 minutes per side. In this case, those arguing against the FCC’s changes to the Telephone Consumer Protection Act have asked for 20 minutes. Oral arguments are scheduled to be heard on October 19. The court did not indicate how much time it would allocate to oral arguments when it set the date for the hearing. A copy of the motion can be downloaded here.
CFPB, FTC SHARE INSIGHTS INTO DEBT COLLECTION INVESTIGATIONS
- Representatives from the Consumer Financial Protection Bureau and the Federal Trade Commission each shed some light into what it takes for their respective agencies to start an investigation into a debt collection complaint. The CFPB, for example, is concerned about the 4 D’s: deception, discrimination, debt traps, and dead ends. The CFPB and the FTC also made explicit comments about the importance of a collection agency substantiating a debt prior to initiating contact with an individual.
NEW YORK PROPOSES DATA SECURITY REGULATION FOR ALL ENTITIES REGULATED BY NYDFS
- The state of New York has proposed data security regulations that would require any institution regulated by the state’s Department of Financial Services to establish and maintain a data security program “designed to protect consumers and ensure the safety and soundness of New York State’s financial services industry.”
