SERVICER FACING LAWSUIT FOR ALLEGEDLY USING HOME INSPECTORS AS COLLECTION AGENTS

  • A mortgage servicer, Specialized Loan Servicing, is facing a class-action lawsuit for allegedly sending “field inspectors” to the homes of delinquent individuals, where in fact those inspectors were actually working to try and collect on the unpaid debts. SLS even tried to invoke the Spokeo defense that the plaintiffs suffered no concrete harm as a result of the actions, but the judge was “unpersuaded.”

COLLECTION AGENCY BUYS DEBT AS MEANS OF DISMISSING LAWSUIT

  • A collection agency used an innovative approach to “buy” its way out of being sued by an individual. The agency, which had obtained a default judgment against the individual, obtained a writ that allowed the local sheriff’s department to sell some of the individual’s possessions to repay the judgment. The agency then purchased the unpaid debt as an asset, and asked the judge to dismiss the suit since the company was now essentially suing itself.

  • From Australia: A number of companies share the “quirky” ways they have used to obtain overdue payments from commercial clients. One collector knocked on the door of an individual and offered to forego half of the overdue balance in exchange for a cup of coffee.

MEDIATOR SHARES NEGOTIATION STRATEGIES FOR CONSUMERS WITH UNPAID DEBTS

  • A mediator from Florida has published an article that shares how willing debt collectors — especially debt buyers — are to negotiate settlements with individuals. “When debt collectors buy debts from financial institutions, they pay pennies on the dollar. Therefore, they are in a good bargaining position. They can profitably accept lump-sum payments that are significantly less than the outstanding debt.”
