TCPA HEARING RAISES INTERESTING DATA POINTS
- Representatives from both sides of the debate shared their insights and suggestions yesterday at a Senate Commerce Committee hearing on the effectiveness of the Telephone Consumer Protection Act. The Attorney General of Indiana conceded that more than half of the unwanted calls that residents of Indiana complain about originate overseas. And a representative of the U.S. Chamber Institute of Legal Reform claimed that reassigned numbers are the largest driver of litigation, with attorney fees averaging $2.4 million in TCPA class-action lawsuits, while the average plaintiff receives $4.12 per case. Senator Clair McCaskill labeled robocalls as the “biggest consumer problem in the country.”
COURT HOLDS EMPLOYEE OF COMPANY LIABLE FOR TCPA VIOLATIONS
- A federal court in New York is holding an employee of a company personally liable for violations to the Telephone Consumer Protection Act. The employee – a vice president of operations who designed and authorized distribution of unsolicited faxes – based on language in the TCPA that holds individuals can be held liable if that had “direct, personal participation in or personally authorized the conduct found to have violated the statute.”
