  • A federal district court has — for the first time — quashed a civil investigative demand letter issued by the Consumer Financial Protection Bureau. Granted, the case involved the CFPB trying to investigate how an organization accredits for-profit colleges, but a win against the CFPB is a win against the CFPB. The court took the CFPB out to the woodshed in issuing its opinion, saying newly formed agencies like the CFPB “must be especially prudent before choosing to plow head long into a field not clearly ceded to them by Congress.”

  • A “renewed” interest in merger & acquisition activity in the collections industry led to nine deals being closed, with a combined enterprise value of $450 million, according to Corporate Advisory Solutions, an advisor to the industry. The interest came from private equity firms, offshore companies, and corporations looking to divest themselves of collections businesses. More consolidation in the industry is expected to occur through the rest of 2016.
