SUPREME COURT HEARS ARGUMENTS ON FDCPA CASE
- The U.S. Supreme Court heard oral arguments yesterday in the case of Sheriff v. Gillie, a case that deals with the Fair Debt Collection Practices Act. Specifically, the case focuses on whether lawyers retained by the Attorney General of Ohio are allowed to use the AG’s letterhead when collecting on debts owed to the AG’s office. It is the first FDCPA case in front of the Supreme Court in a decade. With only eight justices on the bench currently, following the death of Justice Antonin Scalia, a deadlocked ruling will uphold the Sixth Circuit Court of Appeals ruling that the retained lawyers are not officers of the state, and therefore not allowed to use the letterhead, but will not create a legal precedent.
CFPB COMPLAINT SNAPSHOT FOCUSES ON DEBT COLLECTION, BUT ONLY OFFERS ANECDOTAL DATA IN SEVERAL KEY AREAS
- The Consumer Financial Protection Bureau yesterday released its latest monthly complaint snapshot, this time aimed once again at debt collections. But where the agency revealed many detailed statistics on the number of complaints filed by consumers with the bureau and why consumers were filing those complaints, it left out a lot of potentially relevant data points, especially in the area of how many potentially illegal activities were reported.
BILL WOULD ALLOW ILLINOIS CITIES TO SHARE MORE DATA TO HELP COLLECT UNPAID TAXES
- A proposal in the Illinois legislature would open the door for cities to share more financial data with third-party vendors, like collection agencies, that are hired to track down uncollected tax revenue from individuals. Under the current law, only certain employees are allowed to look at the financial data. There are concerns about privacy issues and the potential for individuals to be harassed, according to the bill’s opponents.
LAW FIRM CREATES MINI TCPA POP QUIZ
- The law firm of Womble Carlyle has compiled a sort-of pop quiz on the Telephone Consumer Protection Act and what companies that make outbound calls should or should not do. Meanwhile, the same number of robocalls – 2.3 billion – were placed during the 29 days of February as were placed during the 31 days of January, according to data released yesterday.
