JUSTICE DEPARTMENT WARNS COURTS OF UNLAWFUL FINES
- The Justice Department sent out a letter yesterday to chief judges and court administrators nationwide, warning those courts about incarcerating individuals who have unpaid court fines and fees. The practice of modern day debtor’s prisons may be unconstitutional, the letter warned, and courts should follow a broad set of guidelines when making the decision to jail an individual over an unpaid fine.
CIRCUIT COURT RULES IN FAVOR OF COLLECTION AGENCY IN HANG-UP CASE
- A Circuit Court judge in Pennsylvania awarded a summary judgment to a collection agency, after it was sued by a plaintiff who received two hang-up calls in the span of about three minutes. The plaintiff was not harassed, was not called by an autodialer, and the defendant did not try to hide its identity, according to the motion approving the summary judgment.
NYC PREPARES TO SELL UNPAID LIENSÂ
- The New York City Department of Finance is preparing its annual sale of unpaid tax liens. In just one of New York’s five boroughs – Staten Island – there are more than 1,200 unpaid liens up for sale. The sale will be held on May 12.
MISSISSIPPI COUNTY CONTRACTS WITH DEBT COLLECTOR
- A Mississippi County has contracted with AMS, a private debt collection company, to recover debts owed to the County Justice Court. The amount owed to the court was not published, but AMS was noted to have a 25%-to-35% recovery rate working on behalf of other counties in the state.
