Daily Digest – January 27. What Plaintiffs’ Lawyers Look For; ACA Releases Economic Study

LAWYERS LOOK FOR DEEP POCKETS BEFORE TAKING THE CASE

  • A Florida newspaper spoke with a plaintiffs attorney regarding the types of cases he is looking for when it comes to filing TCPA lawsuits. When asked what type of clients the firm is looking for, this is what was written: “Primarily it’s the people who are getting calls on their cellphones from debt collectors.” But even then, the firm is looking at companies that have the financial standing to be able to pay out if there have been violations. “And unless you are dealing with a good-sized business, someone who has lots of assets or someone with insurance, it can be nearly impossible to get the money.”

GIVING BACK

  • ACA International released a whitepaper yesterday, quantifying the economic impact of third-party debt collections on the overall economy. Debt collectors returned $45 billion to the economy in 2013, according to the study, which works out to nearly $400 in savings for every individual in the country.
