APPEALS COURT UPHOLDS LOWER COURT WIN FOR DEFENDANT IN FDCPA LETTER CASE
- The Court of Appeals for the Third Circuit has issued a non-precedntial opinion upholding a summary judgment ruling from a lower court in favor of a defendant who was being sued for allegedly violating the Fair Debt Collection Practices Act.
SURVEY REVEALS CONSUMER COMMUNICATION & PAYMENT PREFERENCES
- An overwhelming majority of individuals do not wish to be contacted about unpaid debts via phone calls, according to the results of a survey released by Intelligent Contacts. When asked how they would prefer to be contacted about an unpaid bill, only 9% said they would prefer a phone call, compared with 43% who want to be notified via email, 41% who prefer a letter, and 7% who said they’d like to be contacted via a text message.

- Public defenders who work to keep individuals charged with crimes from being sent to prison can not then put those individuals in jail when they don’t pay their lawyers, the Supreme Court of New Hampshire has ruled in what is being called a “historic” decision.
AUDIT RECOMMENDS UTAH HIRE MORE OUTSIDE AGENCIES TO COLLECT UNPAID TAXES
- It appears as though the state of Utah is going to hire more outside collection agencies to help it recover $552 million in unpaid taxes. The recommendation was made via an audit of the Utah State Tax Commission by the state’s legislative audit committee.
GAO CALLS ON STUDENT AID OFFICE TO ENROLL COLLECTION AGENCIES IN CONTINUOUS MONITORING PROGRAM
- The Department of Education’s Office of Federal Student Aid (FSA) is only dropping the ball a little bit in making sure that the private collection agencies it hires keep the personally identifiable information (PII) that is provided to them safe and secure, but where the ball is really being dropped is with banks that make loans on behalf of the government, according to a report released earlier this week by the Government Accountability Office.
