APPEALS COURT REVERSES SUMMARY JUDGMENT AGAINST COLLECTOR IN FDCPA CASE
- The Court of Appeals for the Seventh Circuit has reversed a lower court’s ruling in favor of a plaintiff and granted summary judgment in favor of a collection law firm that was accused of violating the Fair Debt Collection Practices Act by serving a motion to both an individual as well as her attorney, because the attorney had not yet filed notice of appearance before the court.
APPEALS COURT REVIVES FDCPA CLAIM AGAINST COLLECTOR RELATED TO VOICEMAIL MESSAGE
- The Court of Appeals for the Third Circuit has partially reversed a lower court’s dismissal of a lawsuit against a collection agency which was alleged to have violated the Fair Debt Collection Practices Act by using a different company name in voicemail messages left with individuals.
COMMITTEE EXPECTED TO CONFIRM KRANINGER, BUT FULL SENATE VOTE LESS LIKELY
- While it is expected that the Senate Banking Committee will confirm Kathy Kraninger’s nomination to be the next director of the Bureau of Consumer Financial Protection, at least one analyst is predicting that the full Senate may not have a chance to confirm her during this session of Congress, meaning she will have to be re-nominated again next year.
