APPEALS COURT SIDES WITH DEBT COLLECTOR IN FDCPA ‘FLAT-RATING’ CASE
- The Court of Appeals for the Ninth Circuit has affirmed a lower court’s decision in granting summary judgment for the defendants in what is known as a “flat-rating” case after a plaintiff alleged a collection agency violated the Fair Debt Collection Practices Act by implying it was meaningfully involved in collecting on an account.
COLLECTION AGENCY AGREES TO $5 MILLION SETTLEMENT AFTER BEING SUED FOR NOT SAYING CALLS WERE BEING RECORDED
- A medical collection agency based in Nashville has reached a $5 million preliminary settlement in a class-action lawsuit filed against it after the company was accused of recording calls and not notifying individuals on the other end of the phone. The defendant was accused of recording calls with individuals and not notifying them at the outset of the conversation.
COLLECTION AGENCY ANNOUNCES EXPANSION, PLANS TO HIRE 600 NEW EMPLOYEES
- United Collection Bureau Inc., a collection agency based in Toledo, Ohio, has announced plans to renovate a building in Jeffersonville, Ind., and hire an additional 600 workers. About 300 workers will be hired by the end of 2018, according to a published report.
APPEALS COURT UPHOLDS DECISION RESTRICTING PERSONAL LIABILITY IN TCPA CASE
- The Court of Appeals for the Third Circuit has upheld a lower court’s ruling after the owner of a business was found not to be personally liable for violations of the Telephone Consumer Protection Act. In making its ruling, the Third Circuit looked at whether Congress intended for individuals to be held personally liable when it drafted and enacted the TCPA.
