JUDGE RULES SERVICE OF LAWSUIT ENOUGH TO INSTANTLY REVOKE CONSENT UNDER TCPA
- There appears to be a new way for an individual to revoke consent to be contacted under the Telephone Consumer Protection Act: filing a lawsuit against a collection agency. According to Eric Troutman, a partner at the law firm of Dorsey & Whitney, this appears to be the first time that a judge has ruled that filing a lawsuit “operates to revoke consent as a matter of law.” In fact, Troutman, noted, a federal judge in California has granted partial summary judgment in favor of the plaintiff in the class-action lawsuit based on this very ruling.
EXPERT: HEALTHCARE BILLING IS BROKEN
- The healthcare system is so broken that individuals simply wait for a letter from a collection agency and that tells them what needs to be paid when it comes to their medical bills. The process is so confusing that people are not 100% sure of what they owe until they get a letter from a collection agency, said David Krause, Vice President of the Business Improvement Group at Anthem, according to a published report.
CFPB OPENS REVIEW OF ENFORCEMENT PROCESS
- The Consumer Financial Protection Bureau has announced the next area of its operation that it will open up for review by seeking additional information from outside sources: the enforcement process.
COMPTROLLER OF THR CURRENCY TAKES UNUSUAL STEP OF PRAISING MULVANEY
- Joseph Otting, the Comptroller of the Currency, took the unusual step of praising Mick Mulvaney, the acting director of the CFPB, following a meeting between the two. Perhaps the statement was meant to dull criticism being lobbed at Mulvaney by Democrats and consumer advocates who feel that the moves announced during his short tenure as acting director have blunted the consumer protection initiatives at the agency.
TCN MOVES TO NEW HEADQUARTERS
- TCN has announced that it has moved its corporate headquarters to St. George, Utah. The new office includes 12,000 square feet of office space, and provides “more room to accommodate TCN’s future growth,” the company said in a press release announcing the move.
