CASE AGAINST CFPB STRUCTURE TAKES SURPRISING TURN
- The big news of the day yesterday was a surprise ruling from the full Court of Appeals for the District of Columbia which ruled that the leadership structure of the Consumer Financial Protection Bureau is constitutional. The court, in its ruling, essentially reversed its own position, when a three-judge panel from the same court deemed the structure unconstitutional way back in late 2016. While this latest ruling is likely to be appealed to the Supreme Court, it does add another chapter into what is becoming a real plot twister because now, as the book reaches its climactic scenes, all the principal players have not only been replaced, but have switched sides, too.

JUDGE DENIES SUMMARY JUDGMENT REQUESTS FROM BOTH SIDES IN TCPA CONSENT & REVOCATION CASE
- A federal judge in Florida has denied requests from both a plaintiff and the defendant who were seeking partial summary judgment rulings dealing with consent to be contacted and revocation of consent in a Telephone Consumer Protection Act case. The plaintiff said he revoked consent three times, a claim which is being denied by the defendant, who called the plaintiff more than 1,200 times during a 29-month period.
GEORGIA AG GOING AFTER AGENCY OWNER WHO DIDN’T PAY OFF COMPLIANCE FINE
- The owner of a defunct collection agency that owes the state of Georgia nearly $500,000 now finds himself on the other end of the transaction, as a petition has been filed to force the owner to pay up. After entering into a consent agreement to repay about $20,000 of a $460,000 fine, the owner repaid about only $3,500. The Attorney General of Georgia now wants all of it.
JUDGE RULED FDCPA DOES NOT PRE-EMPT STATE LAW CLAIMS
- A federal judge in Utah has ruled that a state law in Utah is not pre-empted by the Fair Debt Collection Practices Act, and denied a motion to dismiss a lawsuit against a collection agency filed by an individual. The ruling, which was issued last week, was first reported by Buckley Sandler.
CFPB ANNOUNCES REVIEW OF ADJUDICATION PROCESS
- The Consumer Financial Protection Bureau has announced the next area of its operation that it is reviewing will be administrative adjudications. The Request For Information will begin next week, according to the CFPB. Since its inception, the CFPB has been involved in eight administrative adjudications. Six of them were settled during the proceedings, one proceeding is pending, and one has been decided. Administrative adjudications are used when a contested matter is not resolved by a consent order.
