- Don Maurice of Maurice Wutscher has written about a case where a collection agency was faulted for relying on a “widely used disclosure” in a collection letter when attempting to collect on a time-barred debt. The plaintiffs allege that the defendants violated the Fair Debt Collection Practices Act by “sending him a dunning letter that was designed to deceive him into paying off part of a debt, even though he was no longer legally required to pay any of it.”
LOAN SERVICER FACING TCPA CLASS-ACTION OVER SKIPTRACING CALLS
- A plaintiff in Pennsylvania, Sandra Corrigan, has filed a class-action lawsuit against Seterus Inc., a mortgage loan servicer, alleging the company violated the Telephone Consumer Protection Act by making automated calls to the cell phones of individuals without obtaining prior consent. In fact, the suit alleges that the defendant was not even attempting to contact individuals with a debt, but instead trying to contact people somehow connected to those individuals, such as friends or relatives.
EDUCATION DEPT. APPROVES 13,000 FORGIVENESS APPLICATIONS, ANNOUNCES CHANGES TO PROCESS
- The Department of Education yesterday announced that it had approved nearly 13,000 applications for student loan debt forgiveness. The approvals come a week after the department was chastised in a report from its own inspector general for not approving the requests in a timely manner, and after a handful of state attorneys general filed a lawsuit against the department for holding up the applications.
COMMERCIAL FILINGS HELP FUEL INCREASE IN TOTAL BANKRUPTCY CASES
- The total number of bankruptcy filings increased in November, compared to the same month last year, fueled by an uptick in commercial filings, according to data released by the American Bankruptcy Institute. The total number of filings was up 2% over last year, but down 7% from October. Personal bankruptcy filings were up 2% on a year-over-year basis.
