FTC OBTAINS $4 MILLION JUDGMENT IN FAKE PAYDAY LOAN DEBT BUYING SCHEME
- The Federal Trade Commission has obtained a $4 million judgment against a group of defendants who sold fake payday loan portfolios. One of the defendants was Joel Jerome Tucker, who is the brother of Scott Tucker, a former racecar driver who recently was found guilty of racketeering in a payday loan scandal. A federal court in Kansas granted a default judgment against the defendants based on a complaint that was filed by the FTC back in 2016.
APPEALS COURT NARROWS FDCPA’S DEFINITION OF DEBT COLLECTOR
- The Eleventh Circuit Court of Appeals has issued an unpublished opinion that further narrows the definition of debt collector under the Fair Debt Collection Practices Act as well as narrowing how that law is applied. The Appeals Court basically blamed the plaintiffs for not doing enough to prove that the defendant — Nationstar Mortgage — is a debt collector as defined under the FDCPA.
