One of the ARM industry’s most notorious filers of lawsuits against collection agencies has set his sights on his next target … one of the ARM industry’s most notorious disputers of debts.
In a case filed in the U.S. District Court for the Northern District of Utah. Craig Cunningham has filed suit against Lexington Law Group, alleging violations of the Telephone Consumer Protection Act. Cunningham alleges that Lexington Law Group made phone calls and sent him a text message soliciting the firm’s credit repair services. Cunningham has filed a class-action lawsuit against Lexington.
Neither Cunningham nor Lexington Law Group are on the Christmas card list of anyone in the ARM industry. Cunningham was the most frequent filer of lawsuits alleging violations of the TCPA, Fair Debt Collection Practices Act, and the Fair Credit Reporting Act. He filed more than 80 lawsuits against collection agencies last year alone, according to data compiled by WebRecon.
Lexington Law Group, meanwhile, is also infamous within the ARM industry, mainly for representing individuals who are disputing debts. The firm sends out thousands of debt dispute notices per year as part of its credit repair service.
Cunningham is looking to include “All persons within the United States who received any telephone calls and/or SMS messages from Defendant to said person’s cellular telephone made through the use of any automatic telephone dialing system or an artificial or prerecorded voice and such person had not previously consented to receiving such calls within the four years prior to the filing of this Complaint,” as part of his class-action.
Cunningham did not say how many times he was contacted by Lexington in his complaint. He is alleging Lexington did not have prior express consent to contact him — or anyone else in the class — on his cell phone using an automated telephone dialing system.
